Terms and Conditions

 

1. General Terms and Definitions. Any individual or entity receiving any product or service from Grizzly Internet, Inc. ("Grizzly Internet") shall here after be referred to as Client. By accepting products and/or services provided by Grizzly Internet, Inc., Client agrees to observe and abide by all of the provisions, terms, and requirements specified in this document.

 

2. Billing. Grizzly Internet shall bill Client for services renders at the published rate of such services at the time rendered. Unless otherwise specified, recurring charges are billed monthly and are due prior to the billed month. Monthly fee for the first month is pro-rated to the end of the month. For each month there after, the full monthly fee is due for any part of a month in which service is provided. Monthly fees are non-refundable. PAST DUE ACCOUNTS WILL BE CHARGED A LATE FEE OF $10 FOR ALL ACCOUNTS 15 DAYS PAST DUE OR OLDER.

 

3. Disclaimer of Liability. Client acknowledges that Grizzly Internet makes no warranty of any kind, express or implied, regarding the reliability or suitability for a particular purpose of its services. Grizzly Internet disclaims any warranty of merchantability or fitness for a particular purpose. Client acknowledges and understands that Grizzly Internet exercises no control over the nature, content, or reliability of the information delivered to Client fro the Internet via Grizzly Internet. Under no circumstances shall Grizzly Internet be held responsible for damages or loss suffered by Client, including but not limited to special, incidental, consequential, or punitive damages, as a result of Client's direct or indirect use of Grizzly Internet services including, but not limited to, errors, delays, loss of information, or interruptions in service caused by Client's or Grizzly Internet's or a third party's negligence, fault, misconduct, or failure to perform. Client acknowledges that Internet access service may be temporarily unavailable for scheduled or unscheduled maintenance, and for other reasons within and outside of the control of Grizzly Internet. Under no circumstances do any such errors, delays, loss of information, or interruptions in service nullify or modify this agreement or any other agreement or contract entered into by Grizzly Internet and Client. Grizzly Internet reserves the right to refuse or terminate service to Client at any time.

 

4. Client Responsibility. Client is responsible for protecting all account passwords and for any authorized or unauthorized use made of Client's account. Client agrees to comply with the rules appropriate to any network to which Client may gain access via the services of Grizzly Internet. Client acknowledges that any proprietary, confidential, or otherwise valuable information that Client desires to keep confidential should not be transmitted over any part of the Internet, nor reside on computers connected to the Internet. Client will not transmit or make available to the Internet any material that is illegal, libelous, tortuous, or likely to result in action against Grizzly Internet or its clients. Client agrees that under no circumstances will the Client use Grizzly Internet's equipment and/or electronic mail addresses in connection with the sending of unsolicited electronic messages, commercial or otherwise, including, but not limited to, the sending of unsolicited mass mailings from another service which in any way implicates the use of Grizzly Internet's service, equipment or any Grizzly Internet electronic mail address.

 

5. Service Plans and Term Commitment. Client agrees to use services purchased from Grizzly Internet in the way the account is intended (i.e. Residential or Business). All accounts have a term commitment of One Month . If client terminates service after service installation and prior to completion of term commitment, client agrees to pay 100% of the remainder of the contract. Termination of service must be in writing to Grizzly Internet 30 day prior to termination date. Past due accounts will be disconnected without notice beyond 30 days past due. To restore service, a $50 reactivation charge will apply. Client will be liable for all past due charges and any early termination fees if account is not brought current and service restored. All account 60 days or more past due will be turn over to collections and service discontinued permanently.

 

6. Service level agreement. In the event Client experiences a service outage for more than two (2) consecutive hours on service and is unable to transmit and receive information from Grizzly Internet's Internet Data Centers to other portions of the Internet and Client notifies Grizzly Internet immediately of such event and Grizzly Internet determines that such inability was caused by Grizzly Internet's failure to provide said services for reasons within Grizzly Internet's reasonable control and not as a result of any actions or inactions of Client or any third parties (including failure of third party equipment), and such inability is not a result of scheduled maintenance of Grizzly Internet's equipment or services, Grizzly Internet will, upon Client's request, credit Client's account the connectivity charges for the length of the outage. Client credit may not exceed one month's service fee in any single calendar month. Client credit may not exceed one month's service fee in any single calendar month.

 

7. Refunds. If service cannot be supplied by Grizzly Internet for any reason, a full refund will be given for any prepaid service fees and equipment returned in new resalable condition. Service may be cancelled without penalty within (30) days of service installation for quality of service issues. A full refund will be given for equipment returned in new resalable condition and for any remaining portion of prepaid monthly service charges pro-rated daily. All other payments are non-refundable. Defective hardware will be repaired or replaced within 15 days of purchase date.

Sections 8 & 9 are specific to Wireless service ONLY!

8. Summer Seasonal Residents. Client may suspend Wireless service for period of time in which Client is not at the physical location. The service may be suspended for up to six (6) months but not less than two (2) months. To reconnect Wireless service Clients agrees to pay a $40 reconnect fee. This only applies to Client(s) that are here for a lengthily duration such as the entire summer or entire winter. Wireless service may only be reconnected once per year. Client must notify at least 30 days in advance to turn on or off Wireless service.

 

9. Periodic Seasonal Residents. Client agrees to pay for Wireless service on an annual basis based off of the estimated usage of Client by Grizzly Internet. If usage exceeds estimation Grizzly Internet reserves the right to charge client for next tier of usage. Wireless service will remain on as long as Client's account is in good standing. There is no need to notify Grizzly Internet if Client is coming to or leaving the area.
